CE Course Details:
Mandatory hours for continuing education have increased from 12 to 18 hours in the
2009-2010 biennium.
Course 1
Listing Contracts |
The course begins by reviewing §240.10 requirements for a valid agency agreement. The outline focuses on issues surrounding the WB-1 Residential
Listing Contract such as: exclusions, incentives, extension, and termination
of the listing.

Course 2
Offer to Purchase |
This course includes the revisions and additions to the WB-11 Residential Offer to Purchase, including the financing contingency, closing proration, delivery, appraisal contingency and distribution of information. Mandatory use date for the new form is March 1, 2010.

Course 3
New Developments |
Course 3 incorporates e-mail delivery and the role of the e-commerce law as
well as a comprehensive discussion of the exceedingly relevant short sales
and foreclosures. This course also covers the impact of the use value assessment
and land use issues including restrictions, easements, zoning, pier
regulation, floodplain and FEMA remapping.

Course 4
Buyer Agency Agreements |
Includes a discussion of pre-agency, client vs. customer, role of selling agent
vs. buyer’s agent, Wis. Stat. §240.10 requirements for a valid agency agreement,
and disclosing buyer agency status. It focuses on the WB-36 Buyer
Agency/Tenant Representation Agreement, including: modifying agency
authorization, excluded properties, compensation/incentives, procuring
cause, agency relationships, proper agency disclosure, and termination of
the agreement.

Elective A
Risk Reduction |
Elective A uncovers advertising administrative rules, the role of the Department
of Regulation and Licensing, common closing issues and forms of ownership.
Elective A also addresses how to avoid liability regarding referral fees, fee
splitting, affiliated business relationships, licensee self-dealing, independent
practice and insurance.

Elective C
Condominiums |
Elective C introduces basic concepts of condominiums and contains a discussion
of condominium ownership. It focuses on the revised WB-4 Condominium
Listing Contract including the timelines for delivery, rescission, and
missing condominium disclosure documents. |

Michael Tobin is a 1980 graduate of Marquette
University Law School. His law practice is located
in Milwaukee, and concentrates on representing
lenders as well as individuals, licensees and
builders. Mike is also a licensed real estate broker
and a member of the Wisconsin State Bar and
the Wisconsin REALTORSŪ Association. He has
taught pre-licensing and continuing education
classes for over 20 years. Mike was recently named
the 2009 Instructor of Year by the Wisconsin
REALTORSŪ Association. |
