REALTOR® Association & MLS Win Antitrust Case

Madison – The Wisconsin REALTORS® Association is pleased to report that the federal district court in Madison, WI on August 25, 2005 ruled in favor of the REALTORS® Association of South Central Wisconsin and the South Central Wisconsin MLS Corporation (SCWMLS) in an important case brought by Jay Reifert. The complaint alleged that the rule requiring membership in a REALTOR® association in order to obtain access to the SCWMLS violates antitrust law. The Honorable Judge John Shabaz rejected this argument, holding that the membership rule does not foreclose competition and does satisfy the requirements of antitrust law. We believe that the decision is in the best interests of REALTORS® and consumers in Wisconsin.
